Introduction
Welcome to Opendatabay Ltd ("Opendatabay", "we", "us" refers to the owner of this platform. "You" refers to any user or visitor of the platform). By using our platform, you agree to comply with and be bound by the following terms and conditions. These terms, together with our Privacy Policy, govern your use of our platform. If you disagree with any part of these terms, please do not use the platform.
Use of the Platform
All content, datasets, data products, and services provided on Opendatabay are provided "as is" and "as available," without any warranties of any kind, either express or implied. Opendatabay expressly disclaims all warranties, including but not limited to:
Opendatabay does not guarantee results or outcomes from use of any data, and is not responsible for any loss, damage, or consequences arising from your use of the platform.
The content provided on this platform is for general information purposes only and may change without notice.
This platform may use cookies and session tokens to enhance user experience and platform security.
We do not guarantee the accuracy, completeness, or suitability of the information provided. Users are responsible for verifying any information before relying on it.
All materials, including design, layout, graphics, and content, are owned by or licensed to Opendatabay. Unauthorized reproduction is prohibited.
Only registered businesses, legal entities, or institutions may register as data providers. Proof of business identity may be required.
We may contact users regarding account performance, platform updates, or operational matters. Non-essential communications can be opted out of by contacting support, though some features may be affected.
Free Datasets & Premium (Paid) Dataset
Opendatabay offers both Free (marked as Free or priced at 0.00 or 0) and Premium datasets. Paid datasets on Opendatabay, also referred to as "Premium" datasets by data providers, do not require an active subscription. You can purchase and download Premium datasets individually, without subscribing to a plan.
Access to premium datasets is governed by the specific terms outlined at the time of purchase or subscription. Users must comply with any licensing or usage restrictions associated with premium datasets and their associated terms or licenses.
Free datasets downloads are limited based on your subscription plan. This ensures fair usage and platform sustainability.
Content and Listings
Links to external websites or platforms are for convenience only. We are not responsible for their content or services.
Users are solely responsible for scanning and verifying any downloaded datasets or files for viruses, malware, or other malicious content.
Users acknowledge and agree that they use the platform, all datasets, and files at their own risk, and Opendatabay is not responsible for any harm, loss, or consequences arising from such use.
If any file or dataset appears suspicious or potentially harmful, users have a duty to report it immediately to Opendatabay and must not redistribute or share the file with others.
During data uploads, users are responsible for ensuring that any datasets or content uploaded comply with applicable laws and do not violate third-party rights.
Opendatabay reserves the right to remove content that violates terms, is fraudulent, or is otherwise inappropriate.
Subscriptions and Access
Opendatabay offers subscription plans that provide access to additional platform features, including downloads, sample previews, AI data queries, and other premium functionalities. Subscription fees are for access to the platform and its services, not for ownership of the underlying datasets.
Users may access a limited number of datasets for free. Paid subscriptions, such as the Explorer, Professional, Enterprise plans, unlock additional downloads and features according to the plan details.
All paid subscriptions automatically renew at the end of each billing period unless canceled prior to the renewal date. You may cancel your subscription at any time, but access to paid features will continue until the end of the current billing period. After the billing period ends, access will revert to the Free Tier.
All subscription plans include defined monthly limits. Unused limits such as downloads do not roll over to the next billing period unless explicitly stated in a plan.
If you cancel within the first 14 days and have not made any downloads, you will receive a full refund for the current month. If you have made downloads, the full charge for the current month will apply, and your subscription will stop at the end of the billing period. This follows your UK legal right to change your mind within 14 days, although this right is generally lost once you start downloading content.
Opendatabay reserves the right to modify subscription plans, pricing, or features at any time, with changes applying to future billing cycles.
Opendatabay will communicate any subscription price changes at least 30 days before your next billing cycle. Current subscribers will maintain their existing price for the remainder of their billing period. You may cancel your subscription before renewal if you do not accept the new pricing. Continued use of the platform after these changes indicates your acceptance of the updated terms. Mid-subscription changes to features will not reduce your current plan benefits until the next renewal.
Datasets available on Opendatabay may include:
- Publicly available or open-source datasets (with attribution to the original source).
- Publicly available or open-source datasets that may have been curated, cleaned, labeled, or otherwise enhanced by Opendatabay or a third-party provider.
- Datasets provided by third-party suppliers, which may be existing datasets or created on-demand by the provider.
- Media assets bundled as data products for AI training, LLM fine-tuning, or other machine learning purposes.
- Pretrained models built on specific datasets, sold as data products.
- Prompts, instructions, or other structured content offered as datasets.
- APIs, programmatic access, or URLs linking to third-party data platforms.
- Other forms of data products as made available by Opendatabay or its partners.
Users should review dataset-specific licensing or terms before use. Subscription provides access to the platform and its features only; it does not grant any additional rights to the datasets themselves beyond what the original license or ownership allows.
Prohibited Activities and Compliance
Scraping, copying, or harvesting data from the platform without authorization is strictly prohibited under these Terms and may constitute unlawful access.
Redistributing purchased datasets is forbidden if the license explicitly restricts redistribution. Any use of data in violation of its license will be treated as a breach of terms.
All illegal activities, including unauthorized use, redistribution, or sale of data, will be reported to relevant authorities.
All images included in datasets or user profiles must be licensed or authorized for use by the uploader. Opendatabay is not responsible for unauthorized images uploaded by data providers. We reserve the right to remove such images or content. The uploader is fully responsible for ensuring proper licensing and permissions.
If Opendatabay discovers unauthorized or illegal activity, including unlicensed images or misuse of data, we reserve the right to contact authorities and take legal action.
Limitation of Liability, Accuracy, and Copyright
Opendatabay, its affiliates, officers, employees, and partners shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to:
- Errors, inaccuracies, omissions, or unreliability in datasets or content
- Merchantability or fitness for a particular purpose
- Uninterrupted or error-free access to the platform
- Any warranties arising from course of dealing, usage, or trade practices
- Loss of data, loss of profits, or business interruption
- Use of datasets or content that may infringe on third-party intellectual property rights
You acknowledge that datasets may come from third-party sources, and while Opendatabay attempts to ensure accuracy, it does not guarantee it. You use all content at your own risk.
You agree to indemnify, defend, and hold harmless Opendatabay from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:
- Your use of the platform
- Violation of these Terms
- Infringement or alleged infringement of any third-party rights, including copyrights, trademarks, or other intellectual property
Dispute Resolution and Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms or your use of Opendatabay shall first be attempted to be resolved through good-faith negotiations between the parties.
For Business Users:
If the dispute cannot be resolved amicably within 30 days, it shall be submitted to binding arbitration under the rules of the London Court of International Arbitration (LCIA), with the arbitration conducted in English and in London, United Kingdom. Judgment on the arbitration award may be entered in any court having jurisdiction.
For Consumer Users (individuals purchasing for personal use):
You retain all statutory rights under UK/EU consumer protection law, including the right to bring claims in your local courts. We encourage initial contact with our support team to resolve issues amicably.
Nothing in these Terms affects your statutory rights, including:
- Right to take legal action in UK courts or your local jurisdiction
- Right to alternative dispute resolution through approved schemes
- Consumer protection under the Consumer Rights Act 2015
- Distance selling regulations and cooling-off periods
For EU consumers: You may also use the EU Online Dispute Resolution platform at Redress in the EU.
Data Sharing and Privacy
All use of personal and business data is governed by our Privacy Policy. We may share necessary information with service providers, data partners, or authorities when legally required.
Intellectual Property
All content on Opendatabay, including text, graphics, logos, images, software, datasets, and other materials, is the property of Opendatabay, its Data Providers, or its Licensors, and is protected by copyright, trademark, and other intellectual property laws.
You may use content solely for personal or business purposes in accordance with these Terms and any applicable dataset-specific licenses. Reproduction, distribution, modification, or creation of derivative works from any content is strictly prohibited without prior written permission from Opendatabay, except as expressly permitted by law or dataset licenses.
Any unauthorized use of content may violate copyright, trademark, and other intellectual property laws, and may result in civil or criminal liability.
Payments
Payments for datasets or services are processed through secure payment processors. We do not store payment card details.
Users are responsible for ensuring accurate payment information and timely payments where applicable.
Refunds are not available for one-off purchases (e.g Premium Datasets) of digital products or services once access has been granted.
Updates to Terms
Opendatabay reserves the right to update these terms at any time.
Continued use of the platform constitutes acceptance of any modifications to these terms.
Governing Law
Your use of the platform and any disputes arising from it are governed by the laws of England & Wales.
